Workers Compensation Benefits
Who is Eligible:
Workers injured while working for any business that is conducted for profit. It doesn’t matter who was at fault for the injury.
What are the Benefits:
- All medical bills related to the injury are covered, whether the worker misses work or not;
- Lost wages for time missed from work, 2/3rds of the average weekly wage, multiplied by the percent of disability, with a maximum of $400 per week. An injured worker's health care provider will determine the extent of the disability.
NOTHING for pain and suffering.
Procedure:
- The employer must be notified of the injury, in writing, within 30 days of the accident. A Form C-3 is used if there is lost time from work. All claims must be filed within two years of the accident.
- The doctor completes a preliminary medical report on Form C-4 and mails it to the appropriate District Office, with copies sent to the employer or its insurance carrier, the injured worker, and his/her representative, if any.
- Within 10 days of notification of the accident, the employer reports the injury to the Board and the insurance company on Form C-2.
- The doctor completes a 15-day report of the injury and treatment on Form C-4 and mails it to the District Office.
- If the claim is not contested by the employer, the doctor submits progress reports on Form C-4 every 45 days to the Board.
